A FEDERAL JUDGE HALTS BIG BEND BORDER CONSTRUCTION WHILE THE LEGAL CHALLENGE CONTINUES

A federal judge in El Paso issued a preliminary injunction Friday stopping border construction and related ground disturbance in the Big Bend Sector unless the government complies with applicable laws. Judge Kathleen Cardone also suspended the environmental waivers challenged in the case. Plaintiffs include Friends of the Ruidosa Church, a river guide and landowner, and conservation advocates. They challenge the government’s waiver authority and raise property and constitutional concerns. Cardone found the plaintiffs likely to succeed on at least one claim and likely to face serious, irreparable harm without an injunction. A fuller explanation will follow. The government defends barriers as necessary for border control. The ruling pauses the challenged work while the case proceeds. The projects’ future remains unresolved.
