Big Bend Border Fight Reaches Supreme Court
Written by THE806ER STAFF-KW · Filed October 22, 2026

President Donald Trump’s administration asked the Supreme Court Wednesday to let border construction resume in the Big Bend region, taking a West Texas land dispute to the nation’s highest court.
The emergency request challenges an October 2 injunction that halted work tied to waivers of environmental and other laws. The government argues Congress gave the homeland security secretary authority to bypass those requirements for border barriers and roads.
Opponents include a river guide, an environmental organization and a group working to preserve a historic church in Ruidosa. They challenged the scope of that authority and described risks to livelihoods, wildlife and cultural resources.
The district judge found the challengers likely to succeed on a claim that the waivers exceeded federal authority. The administration disputes that conclusion and says the halt harms border security.
The filing seeks permission to proceed while the dispute continues. It is not a final Supreme Court ruling.
