WEST TEXAS HEMP BUSINESSES FACE 2 FEDERAL DEADLINES
Written by KAYLA WILLIAMS · Filed October 5, 2026

Federal changes affecting hemp products now have 2 effective dates, a distinction that matters for West Texas retailers and suppliers planning for the rest of 2026.
Most portions of the revised hemp definition were delayed until December 11 by a September funding law. An exclusion for products containing certain synthetic cannabinoids is still scheduled to begin November 12.
The later changes include a limit of 0.4 milligrams per container for combined total THC and other cannabinoids with similar effects in final products. Products outside the hemp definition fall under federal marijuana regulation.
Industrial hemp used for fiber, grain and certain other purposes remains included.
Supporters cite concerns about intoxicating products. Industry groups favor a different regulatory framework. Proposed revisions remain proposals; retailers should distinguish them from enacted requirements.
